Terms of service

Welcome to website4free. These Terms of Service (“Terms”) govern the relationship between website4free (a trading name of VYZRA, hereafter referred to as “we”, “us”, or “our”) and the Client (“you”, “your”). By approving a project, requesting a demo, or making a payment, you agree to these Terms.

1. Identity and Service Scope

1.1 website4free is a trading name of VYZRA, based in Aberdeen, Scotland.

1.2 We provide managed website design, hosting, and maintenance services for new websites. We do not support or migrate existing websites built on external platforms.

1.3 E-commerce Limitations: Our E-commerce service (Advanced Plan) supports up to 50 unique SKUs. Projects requiring more than 50 SKUs are considered outside the scope of website4free and will be referred to our sister agency, VYZRA Creative, for a bespoke quote.

2. The Build Process and Timeline

2.1 The 48-Hour Aim: We aim to provide an initial watermarked demo within 48 business hours.

2.2 Content Delivery: The build timeline only commences once all requested text, images, and branding assets have been received from the Client. Delays in providing content will result in a corresponding delay in the build.

2.3 Complex Projects: Websites requiring user accounts, member areas, or e-commerce functionality will take considerably longer than the 48-hour aim due to technical complexity.

2.4 The Demo: All initial builds are provided as a watermarked demo. The website will not be made live to the public or connected to a domain until the first payment is cleared.

3. Subscription Plans and Support SLAs

3.1 Tiers: We offer three plans: Core, Basic, and Advanced.

3.2 Plan Limits: Each plan covers one (1) domain. Multiple domains require separate plans.

3.3 Support Levels:

  • Core: Email support only (info@website4free.uk). 48-hour response aim.

  • Basic: Priority email and standard messaging (WhatsApp/Web Chat). 48-hour response guarantee.

  • Advanced: Priority email and priority messaging. 24-hour response guarantee.

4. Payments, Billing, and VAT

4.1 Security: Payments are processed via Wix Payments. We do not store or handle card details. We accept Credit/Debit cards, Apple Pay, and Google Pay.
4.2 Annual Discount: Clients paying annually receive a 20% discount.

Core: £299.88/yr | Basic: £479.88/yr | Advanced: £1,247.88/yr.
4.3 VAT: We are currently not VAT registered. If we become VAT registered, we will absorb the cost for existing active clients so their monthly/annual total remains unchanged. New clients joined after registration will have VAT added to their plan.
4.4 Invoicing: Invoices are emailed automatically. Historical records can be requested via accounts@website4free.uk .

5. Intellectual Property (IP) Rights

5.1 Pre-Payment: All IP (including copy, graphics, or designs) created or curated by website4free remains our exclusive property until the first plan payment is made.
5.2 Post-Payment: Upon receipt of the first payment, the Client becomes the owner of the content IP (text, logos, and provided media). The Client is then free to copy or use this content elsewhere.
5.3 The Container: website4free retains all IP and ownership of the website architecture, underlying code, CSS, and custom design elements.
5.4 Leave and Lose It: The website build itself is a hosted service and cannot be transferred or exported to another host.

6. Domains and Managed Services

6.1 External Domains: Clients must point their DNS to our servers. We provide assistance for this.
6.2 Managed Domains: Domains managed by us (£4.99/mo) remain our property until 12 full monthly payments have been made.
6.3 Domain Buyout: If a client wishes to transfer a managed domain away before 12 months, they must pay a buyout fee (the remaining months of the 1-year term, minus a 20% discount).

7. Content Update Hours

7.1 Update hours (3, 6, or 12 per month) cover text, images, layout changes, and new functionality.
7.2 Non-Circumvention: Hours cannot be used to exceed plan limits (e.g., adding a 4th page to a "Core" plan). Hours do not roll over to the next month.

8. One-Off Payments and Add-Ons

8.1 Logo/Branding: Logo design (£99.99) or Brand Guidelines (£159.99) are one-off fees and must be cleared in full before work begins.
8.2 Managed Hours: Extra maintenance or ad management is billed at £19.99/hour on a "Pay As You Go" basis.

9. Late payments, Refunds, and Grace Periods

9.1 No Refunds: As payments are made only after the Client has approved the demo, all payments are strictly non-refundable.
9.2 Late Payments: If a payment fails, the Client has a two (2) business day grace period (excluding weekends and UK bank holidays) to settle the balance.
9.3 Suspension and Deletion: After the grace period, the site will be taken offline. Data is held for 30 days before permanent deletion.
9.4 Promotion: We reserve the right to use any website we design for our own promotional and advertising purposes.

10. Subscription Term and Cancellation

9.1 Initial Commitment: All monthly subscription plans are subject to a minimum initial term of six (6) months. This period is required to allow for proper search engine indexing, SEO stabilization, and performance evaluation.

9.2 Cancellation Restriction: Clients may not terminate their subscription during the initial six-month term. In the event of early abandonment, the remaining balance of the initial term will remain due.

9.3 Rolling Contract: Following the completion of the initial six-month term, the agreement will automatically transition to a one-month rolling contract.

9.4 Post-Initial Termination: After the initial term, clients may cancel their subscription at any time. Cancellation requests must be submitted seven (7) days prior to the next billing cycle.
